ADRÉ, Chad — The chaos in Darfur, the war-ravaged region in Sudan where more than 200,000 civilians have been killed, has spread across the border into Chad, deepening one of the world's worst refugee crises.

Arab gunmen from Darfur have pushed across the desert and entered Chad, stealing cattle, burning crops and killing anyone who resists. The lawlessness has driven at least 20,000 Chadians from their homes, making them refugees in their own country.

Hundreds of thousands more people in this area, along with 200,000 Sudanese who fled here for safety, find themselves caught up in a growing conflict between Chad and Sudan, which have a long history of violence and meddling in each other's affairs.

"You may have thought the terrible situation in Darfur couldn't get worse, but it has," Peter Takirambudde, executive director of the Africa division of Human Rights Watch, said in a recent statement. "Sudan's policy of arming militias and letting them loose is spilling over the border, and civilians have no protection from their attacks, in Darfur or in Chad."

Indeed, the accounts of civilians in eastern Chad are agonizingly familiar to those in western Sudan. One woman, Zahara Isaac Mahamat, described how Arab men on camels and horses had raided her village in Chad, stealing everything they could find and slaughtering all who resisted.

The dead included her husband, Ismail Ibrahim, who tried to prevent the raiders from burning his sorghum and millet fields. Like so many others in this desolate expanse of dust-choked earth, she fled west with her three children, much as people in Darfur have been forced to do in recent years.

"I have lost everything but my children," she said, her face looking much older than her 20 years. She is now a refugee, with thousands of other displaced Chadians, in Kolloye, a village south of here.

"We have three bowls of grain left," she said. "When that is gone, only God can help us."

The spreading chaos is a result of two closely connected conflicts in the neighboring countries.

In Darfur, rebels have been battling government forces and the janjaweed, Arab militias aligned with the government, in a campaign of terror that the Bush administration has called genocide.

The United Nations Security Council has agreed to send troops to protect civilians, but they will take months to arrive. In the meantime, President Bush has said, NATO should help shore up a failing African Union peacekeeping mission there, but a surge of violence has chased tens of thousands of people from their homes in recent weeks.

In Chad, the government is fighting its own war against rebels based in Sudan and bent on ousting Chad's ailing president, Idriss Déby.

The rebels include disgruntled soldiers who defected and tribes tired of being ruled by members of the president's tribe, the Zaghawa, who represent just a small percentage of the population but have long dominated politics and the military.

In a sign of how inseparable the two conflicts have become, President Déby has accused Sudan of supporting the rebellion against his government, and Sudan has long suspected members of Mr. Déby's family of supporting Zaghawa-led rebels in Darfur.

Both sides agreed at a summit meeting in Libya in early February to stop supporting rebels on each other's territory and to tone down the belligerent talk. But Chadian rebels have remained on the Sudanese side of the border, and it is not clear whether Mr. Déby has the capacity to stop members of his clan from supporting Darfur rebels.

If unchecked by international intervention, this complex and volatile mix of government forces, allied militias and at least a half-dozen rebel groups in a remote region awash with weapons will almost inevitably lead to disaster, said John Prendergast, a senior adviser at the International Crisis Group, a nonpartisan nonprofit organization, and an expert on the Darfur conflict.

"The principle strategy of all these actors, both state actors and proxy militias, is to displace people in order to destabilize and undermine the support base of your opponent," he said. "We are going to see an increasing spiral of displacement on both sides of the border and an increasingly dangerous environment for humanitarian workers."

In Chad, the trouble began in December when rebel groups attacked Adré and two other strategic border towns. The Chadian Army repelled the rebels, but it withdrew its troops from garrisons along the border to fortify Adré.

The withdrawal has left a security vacuum into which the janjaweed have rushed. The once well-traveled road between Adré, a bustling border town, and Kolloye has become a terrifying gantlet roamed by bandits and Arab militias. Dozens of villages have emptied; some have been burned. The few aid agencies working in this lawless region avoid the road, using a circuitous route farther west to reach Abéché, the regional capital.

In six days of traveling along the frontier, a reporter and photographer for The New York Times saw just four policemen to keep the peace, equipped only with horses and armed with battered AK-47's. Outside of Adré, only one military patrol was visible.

What appeared to be another military patrol just south of Adré, four soldiers commanded by an aging officer with thick glasses and rheumy eyes, was in fact a search party for the missing cattle of the commanding officer, Adoum Allatchi Gaga. His cows had been stolen by raiders across the border. Asked about the security situation in the region, Mr. Gaga said: "I don't have any idea. I am just looking for my cows."

At the hospital in Adré, the number of gunshot victims in December and January almost doubled, to about 100 a month, relief officials said, a grim sign of the growing lawlessness.

In one ward lay Fatime Youma, a 13-year-old girl with a tube draining the gunshot wound that had punctured her lung.

She was shot, her father explained, by janjaweed who happened upon her and her 16-year-old sister, Zenab, who lay in the next room with a gunshot wound to her arm.

"I was just looking for firewood with my sister," Zenab said softly. "When the raiders saw us we ran away but they shot at us."

Adré's police chief, Mahamat Lony, said he was short of both officers and weapons.

"We have a very catastrophic situation," he said. "We have a very long frontier with Sudan, and many heavily armed raiders on the other side. There have been many incursions, and they attack the population. We have many displaced, and no one is helping them."

The man charged with defending Chad's border and protecting refugees and civilians is Gen. Abakar Youssouf Mahamat Itno, 38, a nephew of President Déby who was dispatched here the day of the rebel attack.

"Sudan wants to export the war in Darfur to us here," General Itno said at his camp in the hills above Adré. "They want to use the janjaweed they armed to terrorize Darfur, to terrorize our population. We will not allow it."

Even so, he acknowledged his inability to patrol the border areas. "It is a long border," he said. "We cannot be everywhere at once."

That Chadian rebels have found sanctuary in Sudan is beyond doubt. Geneina, the capital of Western Darfur, resembles a garrison town; armed men from at least six forces are visible on the streets, as are Arabs in street clothes carrying AK-47's. Local residents identify them as janjaweed.

In the market in the evening, Chadian Army deserters wearing their distinctive turbans sit drinking tea, submachine guns beside them. Freshly dug machine-gun pits surround the police and army stations, and aid agencies are putting sandbags around their offices. The Chadian rebels have new weapons, uniforms and vehicles, aid officials in Geneina said, leading many to conclude that they are getting support from the Sudanese government.

With so much firepower on the Sudanese side of the border, residents in villages like Adé, south of Adré, have borne almost daily attacks.

"There is no security here," said Hisseine Kassar Mostapha, secretary general of the local government in Adé. "We are out here completely on our own, with no one to protect us."

The lack of security means little assistance from international aid groups. In Kolloye, 10,000 Chadians, refugees like Ms. Mahamat, live in roofless grass shelters that give little protection from the frigid night air and no shelter from the punishing desert sun. Water is scarce and food supplies are low, villagers said. The only assistance is a mobile clinic run by Doctors Without Borders that operates three times a week.

One refugee, Kaltam Abdullah, cradled her year-old son in her lap; his head lolled on his neck, his eyes were glazed and his limbs slender.

"He has had running stomach for 10 days," Ms. Abdullah said. "He is coughing. But there is no doctor."

Meanwhile, Sudanese refugees continue to arrive in Chad. Last month there were 1,500 arrivals, up from 1,000 over the previous three months, said Claire Bourgeois, the deputy representative for the Office of the United Nations High Commissioner for Refugees in Abéché. She said all the camps were full except one, and that it was filling up quickly.

Several camps holding tens of thousands of refugees will be moved further west, Ms. Bourgeois said, to protect the refugees from the violence. But safety remains a serious problem, she added, and "if there is no security, the humanitarian actors will leave."

Sudanese refugees who have arrived in recent weeks recount grim tales of slaughter, rape and plunder.

Ibrahim Suleiman Mahamat, a herder from the Masalit tribe who lived along the border, said janjaweed had stolen his livestock: 40 cows, 20 goats and sheep, 2 camels and 2 horses. Penniless and terrified, he had little choice but to cross into Chad with his two wives and six children. Dozens of relatives left behind plan to join him, he said. Even in the relative safety of the Gaga Refugee Camp, far west of the border, he said, he does not feel safe.

"We are in a very dangerous situation," Mr. Mahamat said. "What happens if there is a war in the country you are from and the country you have fled to? We are nowhere. There is nowhere for us to go."

Since 9/11, whenever the Bush team has found itself in political trouble, it has played the national security card against Democrats. It has worked so well that Karl Rove, in a recent speech to the Republican National Committee, made it a campaign theme for 2006.

He said America today faces "a ruthless enemy" and therefore needs "a commander in chief and a Congress who understand the nature of the threat and the gravity of the moment America finds itself in. President Bush and the Republican Party do. Unfortunately, the same cannot be said for many Democrats."

Mr. Rove added: "Republicans have a post-9/11 worldview, and many Democrats have a pre-9/11 worldview. That doesn't make them unpatriotic — not at all. But it does make them wrong — deeply and profoundly and consistently wrong."

I particularly like the line "that doesn't make them unpatriotic," when that was exactly the political slur Mr. Rove was trying to implant.

So I understand why Democrats were eager to turn the soft-on-terrorism card back on President Bush when it was revealed that P&O, the navigation company based in London — which has been managing the ports of New York, New Jersey, Baltimore, New Orleans, Miami and Philadelphia — had been bought by Dubai Ports World, a company owned by the Dubai monarchy in the United Arab Emirates, an Arab Gulf state, and that the Bush team had approved the Dubai takeover of the U.S. port operations.

I also understand why many Republicans are now running away from the administration. They know that if they don't distance themselves from Mr. Bush, some Democrats are going to play this very evocative, very visual "giving away our ports to the Arabs" card against them in the coming elections. Yes, you reap what you sow.

But while I have zero sympathy for the political mess in which the president now finds himself, I will not join this feeding frenzy. On the pure merits of this case, the president is right. The port deal should go ahead. Congress should focus on the N.S.A. wiretapping. Not this.

As a country, we must not go down this road of global ethnic profiling — looking for Arabs under our beds the way we once looked for commies. If we do — if America, the world's beacon of pluralism and tolerance, goes down that road — we will take the rest of the world with us. We will sow the wind and we will reap the whirlwind.

If there were a real security issue here, I'd join the critics. But the security argument is bogus and, I would add, borderline racist. Many U.S. ports are run today by foreign companies, but the U.S. Coast Guard still controls all aspects of port security, entry and exits; the U.S. Customs Service is still in charge of inspecting the containers; and U.S. longshoremen still handle the cargos.

The port operator simply oversees the coming and going of ships, making sure they are properly loaded and offloaded in the most cost-effective manner. As my colleague David E. Sanger reported: "Among the many problems at American ports, said Stephen E. Flynn, a retired Coast Guard commander who is an expert on port security at the Council on Foreign Relations, 'who owns the management contract ranks near the very bottom.' "

What ranks much higher for me is the terrible trend emerging in the world today: Sunnis attacking Shiite mosques in Iraq, and vice versa. Danish caricatures of the Prophet Muhammad, and violent Muslim protests, including Muslims killing Christians in Nigeria and then Christians killing Muslims. And today's Washington Post story about how some overzealous, security-obsessed U.S. consul in India has created a huge diplomatic flap — on the eve of Mr. Bush's first visit to India — by denying one of India's most respected scientists a visa to America on the grounds that his knowledge of chemistry might be a threat. The U.S. embassy in New Delhi has apologized.

My point is simple: the world is drifting dangerously toward a widespread religious and sectarian cleavage — the likes of which we have not seen for a long, long time. The only country with the power to stem this toxic trend is America.

People across the world still look to our example of pluralism, which is like no other. If we go Dark Ages, if we go down the road of pitchfork-wielding xenophobes, then the whole world will go Dark Ages.

There is a poison loose today, and America — America at its best — is the only antidote. That's why it is critical that we stand by our principles of free trade and welcome the world to do business in our land, as long as there is no security threat. If we start exporting fear instead of hope, we are going to import everyone else's fears right back. That is not a world you want for your kids.

I have no doubt that the Danish cartoons mocking the Prophet Muhammad have caused real offense to many Muslims. I'm glad my newspaper didn't publish them. But there is something in the worldwide Muslim reaction to these cartoons that is excessive, and suggests that something else is at work in this story. It's time we talked about it.

To understand this Danish affair, you can't just read Samuel Huntington's classic, "The Clash of Civilizations." You also need to read Karl Marx, because this explosion of Muslim rage is not just about some Western insult. It's also about an Eastern failure. It is about the failure of many Muslim countries to build economies that prepare young people for modernity — and all the insult, humiliation and frustration that has produced.

Today's world has become so wired together, so flattened, that you can't avoid seeing just where you stand on the planet — just where the caravan is and just how far ahead or behind you are. In this flat world you get your humiliation fiber-optically, at 56K or via broadband, whether you're in the Muslim suburbs of Paris or Kabul. Today, Muslim youth are enraged by cartoons in Denmark. Earlier, it was a Newsweek story about a desecrated Koran. Why? When you're already feeling left behind, even the tiniest insult from afar goes to the very core of your being — because your skin is so thin.

India is the second-largest Muslim country in the world, but the cartoon protests here, unlike those in Pakistan, have been largely peaceful. One reason for the difference is surely that Indian Muslims are empowered and live in a flourishing democracy. India's richest man is a Muslim software entrepreneur. But so many young Arabs and Muslims live in nations that have deprived them of any chance to realize their full potential.

The Middle East Media Research Institute, called Memri, just published an analysis of the latest employment figures issued by the U.N.'s International Labor Office. The I.L.O. study, Memri reported, found that "the Middle East and North Africa stand out as the region with the highest rate of unemployment in the world": 13.2 percent. That is worse than in sub-Saharan Africa.

While G.D.P. in the Middle East-North Africa region registered an annual increase of 5.5 percent from 1993 to 2003, productivity, the measure of how efficiently these resources were used, increased by only about 0.1 percent annually — better than only one region, sub-Saharan Africa.

The Arab world is the only area in the world where productivity did not increase with G.D.P. growth. That's because so much of the G.D.P. growth in this region was driven by oil revenues, not by educating workers to do new things with new technologies.

Nearly 60 percent of the Arab world is under the age of 25. With limited job growth to absorb them, the I.L.O. estimates, the region is spinning out about 500,000 more unemployed people each year. At a time when India and China are focused on getting their children to be more scientific, innovative thinkers, educational standards in much of the Muslim world — particularly when it comes to science and critical inquiry — are not keeping pace.

Pervez Hoodbhoy, a professor of nuclear physics at Quaid-i-Azam University in Islamabad, Pakistan, bluntly wrote the following in Global Agenda 2006, the journal of the recent Davos World Economic Forum:

"Pakistan's public (and all but a handful of private) universities are intellectual rubble, their degrees of little consequence. ... According to the Pakistan Council for Science and Technology, Pakistanis have succeeded in registering only eight patents internationally in 57 years. ...

"[Today] you seldom encounter a Muslim name in scientific journals. Muslim contributions to pure and applied science — measured in terms of discoveries, publications, patents and processes — are marginal. ... The harsh truth is that science and Islam parted ways many centuries ago. In a nutshell, the Muslim experience consists of a golden age of science from the ninth to the 14th centuries, subsequent collapse, modest rebirth in the 19th century, and a profound reversal from science and modernity, beginning in the last decades of the 20th century. This reversal appears, if anything, to be gaining speed."

No wonder so many young people in this part of the world are unprepared, and therefore easily enraged, as they encounter modernity. And no wonder backward religious leaders and dictators in places like Syria and Iran — who have miserably failed their youth — are so quick to turn their young people's anger against an insulting cartoon and away from themselves and the rot they have wrought.

ATLANTA (AP) -- Rep. John Lewis said he will officially launch his bid on Monday for an 11th term in Congress, kicking off his campaign on his birthday.

Lewis, who turns 66 on Monday, is a veteran civil rights activist and the longest-serving of Georgia's 13 House members. He has recently been pushing for congressional renewal of the Voting Rights Acts of 1965.

"We must make this world a little more peaceful and a little more orderly and re-establish America with a greater sense of respect and credibility," said Lewis, a Democrat.

State Rep. Tyrone Brooks, his longtime friend, said Lewis' announcement wasn't a surprise and that he should clearly be the favorite in the upcoming race.

"I've always thought he would stay until he could no longer serve. He's still relatively young," Brooks said.

Lewis served as an Atlanta City Council member until he was elected to Congress in 1986. He was a prominent participant in the Selma-to-Montgomery civil rights march in 1965.

White House Knew of Levee's Failure on Night of Storm

WASHINGTON, Feb. 9 — In the aftermath of Hurricane Katrina, Bush administration officials said they had been caught by surprise when they were told on Tuesday, Aug. 30, that a levee had broken, allowing floodwaters to engulf New Orleans.

But Congressional investigators have now learned that an eyewitness account of the flooding from a federal emergency official reached the Homeland Security Department's headquarters starting at 9:27 p.m. the day before, and the White House itself at midnight.

The Federal Emergency Management Agency official, Marty Bahamonde, first heard of a major levee breach Monday morning. By late Monday afternoon, Mr. Bahamonde had hitched a ride on a Coast Guard helicopter over the breach at the 17th Street Canal to confirm the extensive flooding. He then telephoned his report to FEMA headquarters in Washington, which notified the Homeland Security Department.

"FYI from FEMA," said an e-mail message from the agency's public affairs staff describing the helicopter flight, sent Monday night at 9:27 to the chief of staff of Homeland Security Secretary Michael Chertoff and recently unearthed by investigators. Conditions, the message said, "are far more serious than media reports are currently reflecting. Finding extensive flooding and more stranded people than they had thought — also a number of fires."

Michael D. Brown, who was the director of FEMA until he resigned under pressure on Sept. 12, said in a telephone interview Thursday that he personally notified the White House of this news that night, though he declined to identify the official he spoke to.

White House officials have confirmed to Congressional investigators that the report of the levee break arrived there at midnight, and Trent Duffy, the White House spokesman, acknowledged as much in an interview this week, though he said it was surrounded with conflicting reports.

But the alert did not seem to register. Even the next morning, President Bush, on vacation in Texas, was feeling relieved that New Orleans had "dodged the bullet," he later recalled. Mr. Chertoff, similarly confident, flew Tuesday to Atlanta for a briefing on avian flu. With power out from the high winds and movement limited, even news reporters in New Orleans remained unaware of the full extent of the levee breaches until Tuesday.

The federal government let out a sigh of relief when in fact it should have been sounding an "all hands on deck" alarm, the investigators have found.

This chain of events, along with dozens of other critical flashpoints in the Hurricane Katrina saga, has for the first time been laid out in detail following five months of work by two Congressional committees that have assembled nearly 800,000 pages of documents, testimony and interviews from more than 250 witnesses. Investigators now have the documentation to pinpoint some of the fundamental errors and oversights that combined to produce what is universally agreed to be a flawed government response to the worst natural disaster in modern American history.

On Friday, Mr. Brown, the former FEMA director, is scheduled to testify before the Senate Homeland Security and Governmental Affairs Committee. He is expected to confirm that he notified the White House on that Monday, the day the hurricane hit, that the levee had given way, the city was flooding and his crews were overwhelmed.

"There is no question in my mind that at the highest levels of the White House they understood how grave the situation was," Mr. Brown said in the interview.

The problem, he said, was the handicapping of FEMA when it was turned into a division of the Homeland Security Department in 2003.

"The real story is with this new structure," he said. "Why weren't more things done, or what prevented or delayed Mike Brown from being able to do what he would have done and did do in any other disaster?"

Although Mr. Bahamonde said in October that he had notified Mr. Brown that Monday, it was not known until recently what Mr. Brown or the Homeland Security Department did with that information, or when the White House was told.

Missteps at All Levels

It has been known since the earliest days of the storm that all levels of government — from the White House to the Department of Homeland Security to the Louisiana Capitol to New Orleans City Hall — were unprepared, uncommunicative and phlegmatic in protecting Gulf Coast residents from the floodwaters and their aftermath. But an examination of the latest evidence by The New York Times shines a new light on the key players involved in the important turning points: what they said, what they did and what they did not do, all of which will soon be written up in the committees' investigative reports.

Among the findings that emerge in the mass of documents and testimony were these:

¶Federal officials knew long before the storm showed up on the radar that 100,000 people in New Orleans had no way to escape a major hurricane on their own and that the city had finished only 10 percent of a plan for how to evacuate its largely poor, African-American population.

¶Mr. Chertoff failed to name a principal federal official to oversee the response before the hurricane arrived, an omission a top Pentagon official acknowledged to investigators complicated the coordination of the response. His department also did not plan enough to prevent a conflict over which agency should be in charge of law enforcement support. And Mr. Chertoff was either poorly informed about the levee break or did not recognize the significance of the initial report about it, investigators said.

¶The Louisiana transportation secretary, Johnny B. Bradberry, who had legal responsibility for the evacuation of thousands of people in nursing homes and hospitals, admitted bluntly to investigators, "We put no plans in place to do any of this."

¶Mayor C. Ray Nagin of New Orleans at first directed his staff to prepare a mandatory evacuation of his city on Saturday, two days before the storm hit, but he testified that he had not done so that day while he and other city officials struggled to decide if they should exempt hospitals and hotels from the order. The mandatory evacuation occurred on Sunday, and the delay exacerbated the difficulty in moving people away from the storm.

¶The New Orleans Police Department unit assigned to the rescue effort, despite many years' worth of flood warnings and requests for money, had just three small boats and no food, water or fuel to supply its emergency workers.

¶Investigators could find no evidence that food and water supplies were formally ordered for the Convention Center, where more than 10,000 evacuees had assembled, until days after the city had decided to open it as a backup emergency shelter. FEMA had planned to have 360,000 ready-to-eat meals delivered to the city and 15 trucks of water in advance of the storm. But only 40,000 meals and five trucks of water had arrived.

Representative Thomas M. Davis III, Republican of Virginia, chairman of the special House committee investigating the hurricane response, said the only government agency that performed well was the National Weather Service, which correctly predicted the force of the storm. But no one heeded the message, he said.

"The president is still at his ranch, the vice president is still fly-fishing in Wyoming, the president's chief of staff is in Maine," Mr. Davis said. "In retrospect, don't you think it would have been better to pull together? They should have had better leadership. It is disengagement."

One of the greatest mysteries for both the House and Senate committees has been why it took so long, even after Mr. Bahamonde filed his urgent report on the Monday the storm hit, for federal officials to appreciate that the levee had broken and that New Orleans was flooding.

Eyewitness to Devastation

As his helicopter approached the site, Mr. Bahamonde testified in October, there was no mistaking what had happened: large sections of the levee had fallen over, leaving the section of the city on the collapsed side entirely submerged, but the neighborhood on the other side relatively dry. He snapped a picture of the scene with a small camera.

"The situation is only going to get worse," he said he warned Mr. Brown, then the FEMA director, whom he called about 8 p.m. Monday Eastern time to report on his helicopter tour.

"Thank you," he said Mr. Brown replied. "I am now going to call the White House."

Citing restrictions placed on him by his lawyers, Mr. Brown declined to tell House investigators during testimony if he had actually made that call. White House aides have urged administration officials not to discuss any conversations with the president or his top advisors and declined to release e-mail messages sent among Mr. Bush's senior advisors.

But investigators have found the e-mail message referring to Mr. Bahamonde's helicopter survey that was sent to John F. Wood, chief of staff to Secretary Chertoff at 9:27 p.m. They have also found a summary of Mr. Bahamonde's observations that was issued at 10:30 p.m. and an 11:05 p.m. e-mail message to Michael Jackson, the deputy secretary of homeland security. Each message describes in detail the extensive flooding that was taking place in New Orleans after the levee collapse.

Given this chain of events, investigators have repeatedly questioned why Mr. Bush and Mr. Chertoff stated in the days after the storm that the levee break did not happen until Tuesday, as they made an effort to explain why they initially thought the storm had passed without the catastrophe that some had feared.

"The hurricane started to depart the area on Monday, and then Tuesday morning the levee broke and the water started to flood into New Orleans," Mr. Chertoff said on CBS's "Face the Nation" on Sunday, Sept. 4, the weekend after the hurricane hit.

Mr. Chertoff and White House officials have said that they were referring to official confirmation that the levee had broken, which they say they received Tuesday morning from the Army Corps of Engineers. They also say there were conflicting reports all day Monday about whether a breach had occurred and noted that they were not alone in failing to recognize the growing catastrophe.

Mr. Duffy, the White House spokesman, said it would not have made much difference even if the White House had realized the significance of the midnight report. "Like it or not, you cannot fix a levee overnight, or in an hour, or even six hours," he said.

But Senator Susan Collins, Republican of Maine and chairwoman of the Senate Committee on Homeland Security and Governmental Affairs, said it was obvious to her in retrospect that Mr. Chertoff, perhaps in deference to Mr. Brown's authority, was not paying close enough attention to the events in New Orleans and that the federal response to the disaster may have been slowed as a result.

"Secretary Chertoff was too disengaged from the process," Ms. Collins said in an interview.

Compounding the problem, once Mr. Chertoff learned of the levee break on Tuesday, he could not reach Mr. Brown, his top emergency response official, for an entire day because Mr. Brown was on helicopter tours of the damage.

Senator Joseph I. Lieberman of Connecticut, the ranking Democrat on the homeland security committee, said the government confusion reminded him of the period surrounding the attacks of Sept. 11, 2001.

"Information was in different places, in that case prior to the attack," Mr. Lieberman said, "and it wasn't reaching the key decision makers in a coordinated way for them to take action."

Russ Knocke, a homeland security spokesman, said that although Mr. Chertoff had been "intensely involved in monitoring the storm" he had not actually been told about the report of the levee breach until Tuesday, after he arrived in Atlanta.

"No one is satisfied with the response in the early days," Mr. Knocke said.

But he rejected criticism by Senator Collins and others that Mr. Chertoff was disengaged.

"He was not informed of it," Mr. Knocke said. "It is certainly a breakdown. And through an after-action process, that is something we will address."

The day before the hurricane made landfall, the Homeland Security Department issued a report predicting that it could lead to a levee breach that could submerge New Orleans for months and leave 100,000 people stranded. Yet despite these warnings, state, federal and local officials acknowledged to investigators that there was no coordinated effort before the storm arrived to evacuate nursing homes and hospitals or others in the urban population without cars.

Focus on Highway Plan

Mr. Bradberry, the state transportation secretary, told an investigator that he had focused on improving the highway evacuation plan for the general public with cars and had not attended to his responsibility to remove people from hospitals and nursing homes. The state even turned down an offer for patient evacuation assistance from the federal government.

In fact, the city was desperately in need of help. And this failure would have deadly consequences. Only 21 of the 60 or so nursing homes were cleared of residents before the storm struck. Dozens of lives were lost in hospitals and nursing homes.

One reason the city was unable to help itself, investigators said, is that it never bought the basic equipment needed to respond to the long-predicted catastrophe. The Fire Department had asked for inflatable boats and generators, as well as an emergency food supply, but none were provided, a department official told investigators.

Timothy P. Bayard, a police narcotics commander assigned to lead a water rescue effort, said that with just three boats, not counting the two it commandeered and almost no working radios, his small team spent much of its time initially just trying to rescue detectives who themselves were trapped by rising water.

The investigators also determined that the federal Department of Transportation was not asked until Wednesday to provide buses to evacuate the Superdome and the convention center, meaning that evacuees sat there for perhaps two more days longer than necessary.

Mr. Brown acknowledged to investigators that he wished, in retrospect, that he had moved much earlier to turn over major aspects of the response effort to the Department of Defense. It was not until the middle of the week, he said, that he asked the military to take over the delivery and distribution of water, food and ice.

"In hindsight I should have done it right then," Mr. Brown told the House, referring to the Sunday before the storm hit.

ATLANTA (AP) -- 14-hundred people lined up outside the state Capitol to pay their respects to Coretta Scott King.

Jeenie Coston, a 48-year-old from Marietta, says she waited for more than five hours for her chance to pay tribute to the first woman and the first black person to lie in honor at the Capitol's Rotunda.

Coston says she was six years old when Martin Luther King Junior was assassinated and still remembers it.

She says if the Kings had not done what they did, she does not know where the civil rights movement would be today.

Some people threw roses at King's casket as it made its way through Atlanta's streets this morning in a horse-drawn carriage. Others shared tissue to blot their tears. One man held a portrait of Martin Luther King.

Fifty-year-old Chris Thomas flew down from Connecticut with a friend to pay his respects.

Thomas says he want to show his gratitude to a woman who was so important for the peace movement.

WASHINGTON, Feb. 1 — The Bush administration is rebuffing requests from members of the Senate Judiciary Committee for its classified legal opinions on President Bush's domestic spying program, setting up a confrontation in advance of a hearing scheduled for next week, administration and Congressional officials said Wednesday.

The Justice Department is balking at the request so far, administration officials said, arguing that the legal opinions would add little to the public debate because the administration has already laid out its legal defense at length in several public settings.

But the legality of the program is known to have produced serious concerns within the Justice Department in 2004, at a time when one of the legal opinions was drafted. Democrats say they want to review the internal opinions to assess how legal thinking on the program evolved and whether lawyers in the department saw any concrete limits to the president's powers in fighting terrorism.

With the committee scheduled to hold the first public hearing on the eavesdropping program on Monday, the Justice Department's stance could provoke another clash between Congress and the executive branch over access to classified internal documents. The administration has already drawn fire from Democrats in the last week for refusing to release internal documents on Hurricane Katrina as well as material related to the lobbyist Jack Abramoff.

Several Democrats and at least one Republican have pressed the Justice Department in recent days to give them access, even in a closed setting, to the internal documents that formed the legal foundation of the surveillance program. But when asked whether the classified legal opinions would be made available to Congress, a senior Justice Department official said Wednesday, "I don't think they're coming out."

The official said the administration's legal arguments had already been aired, most prominently in a 42-page "white paper" issued last month. "Everything that's in those memos was in the white paper," said the official, who, like other administration and Congressional officials, was granted anonymity because classified material was involved.

While the administration has spent much of the last two weeks defending the legality and necessity of the surveillance program, the Judiciary Committee session will be the first Congressional hearing on it. Senator Arlen Specter, the Pennsylvania Republican who leads the panel, said Wednesday that he had "a lot of questions" the administration had not yet adequately answered about the program's legal rationale.

Mr. Specter would not address the committee's request for the classified legal opinions, except to say, "that's not a closed matter — we're still working on that."

Several Democrats on the panel have made formal requests for the legal opinions, including Senator Dianne Feinstein of California.

In the interview, Mr. Specter said that he wanted a fuller explanation as to how the Justice Department asserts that the eavesdropping operation does not conflict with the 1978 Foreign Intelligence Surveillance Act, which set strict and "exclusive" guidelines for intelligence wiretaps.

The operation was approved by President Bush, to allow the National Security Agency to conduct wiretaps on Americans' international communications without a court warrant. Mr. Specter said his view was that the operation "violates FISA — there's no doubt about that."

He also questioned why the administration did not go to Congress or the intelligence court to seek changes in the process before moving ahead on its own with the classified program after the Sept. 11 attacks.

Representative Jane Harman, the California Democrat who was one of the few members of the Congress briefed on the operation, echoed that same theme in a letter sent Wednesday to President Bush.

She said in the letter that with changes made to the foreign intelligence law after the Sept. 11 attacks, the eavesdropping operations of the N.S.A. "can and should" be covered by court-approved warrants, "without circumventing" the process.

Attorney General Alberto R. Gonzales will be the lone witness at next week's hearing, and his aides said he was entering it with confidence about the program's legal footing, based on both the president's inherent constitutional authority and a Congressional authorization after the Sept. 11 attacks to use military force against terrorists. But both Republicans and Democrats said Wednesday that they planned to question Mr. Gonzales about those assertions.

While the administration has laid out its legal defense repeatedly in the last two weeks, the formal legal opinions developed at the Justice Department to justify the program remain classified. The administration has refused even to publicly acknowledge the existence of the memorandums, but The New York Times has reported that two sets of legal opinions by the Justice Department's Office of Legal Counsel asserted the president's broad power to order wiretaps without warrants in protecting national security.

The first Justice Department opinion is thought to have been written in late 2001 or early 2002 by John Yoo, a strong proponent of expanded presidential powers in wartime. The second opinion, officials said, was drafted by Jack Goldsmith, another senior department official who later left to teach at Harvard. It came in 2004 at a time some senior officials at the Justice Department were voicing concerns about the program's legal foundation and refusing to sign off on its reauthorization.

Those concerns led in part to the suspension of the surveillance program for several months and also appear to have led Mr. Goldsmith and other Justice Department lawyers to revisit the question of its legal underpinnings in order to satisfy those concerns.

Members of the Judiciary Committee have sought access to the memorandums, officials said. Some Democrats speculate that the classified memos may contain far-reaching and potentially explosive legal theories similar to those advocated by Mr. Yoo and others, and later disavowed by the Justice Department, regarding policies on torture.

In a letter sent Wednesday to Mr. Gonzales, Mrs. Feinstein said the legal opinions and other internal documents were needed for Congress to assess whether the president "has the inherent authority to authorize this surveillance."

With two additional hearings scheduled on the program after Mr. Gonzales's appearance, Mr. Specter said he was also considering seeking testimony from former Justice Department officials, and perhaps even input from the FISA court itself.

But Senator Charles E. Schumer, a New York Democrat who also serves on the Judiciary Committee, said the panel should consider issuing subpoenas if the administration is not more forthcoming in providing documents and witnesses.

"Without the Justice Department memos and without more witnesses, it's hard to se how anything other than a rehashing of the administration line is going to happen," Mr. Schumer said Wednesday. "I am worried that these hearings could end up telling us very little when the American people are thirsty to find out what happened here."
